According to the article 35 the law about ownership 2644in release law 4916 article 19 from 03.07.2003: ‘Foreign individual persons and trading companies, which form juriditial person and are created abroad according the laws of their own country, have the right to buy ral estate properties which are in the borders of Turkish Republic. The main condition of the reciprocity principle is adjudgment by Turkish Republic the same rights for foreign residents and trading companies as the rights of residents of Turkey.
Aftre changing of this law the most important condition of it became adjusting of the rights of Turish Republic residents and trading companies who became juriditial person according to the laws of their country with the rights f their own residents and trading companies.
Reciprocity principle
In the act of Cabinet of Ministers of Turkish Republic №2/13394 from 29.05.1940 is exectly destiunguished what is considered to be real reciprocity principle. According to the act, reciprocity principle is not only existance of law base but also existing of the mechanism of its application in real life. In the case of not observing the conditions of reciprocity principle, the same restrictions conserning the foreign resident in Turkey will be applied as they were applied in te foreign country.
Reciprocity principles are not nesessary for the next catgoies of people:
1)for stateless persons, because of absence of the state according to which reciprocity principle will be observed;
2) for refugees (Law №359 from 26.08.1961 article.7/2). Reprioci principle is not obseved for the refugeer persons who live in Turkey 3 and more years. Buing poperty they have to show the document that prooves their refugee status;
3) foreign individal an juriditial persons who make big investments in the touristic sphere. According to the article 8/E the law of promotion of tourizm № 2634 when such a person buys properties in touristic areas the reciprocity principle and other restrictions are not observed concerning this person.
Law restrictions:
Buying property in Turkish republic foreign residents have to follow the next limitations:
1) buying, renting or giving rights to use some type of property by foreign resident or trading company which is considered to be juriditial person in military and securit zones is impossible (the law 2565 about closed military zones and secrity zne);
2)for buying real estate property of area more then 30 hectar by foreign residents Cabinet of Minister’s permition is needed( Ownership law № 2644, article 35),except of the cases of iharitance.
